1. Terms
By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable patent, copyright and trade mark law.

2. Use License
a. Permission is granted to temporarily download one copy of the materials (information or software) on Xbidit's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  i. modify or copy the materials;
  ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  iii. attempt to decompile or reverse engineer any software contained on Xbidit's web site;
  iv. remove any copyright or other proprietary notations from the materials; or
  v. transfer the materials to another person or "mirror" the materials on any other server.
b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Xbidit at any time. 4. Limitations
In no event shall Xbidit or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Xbidit's Internet site, even if Xbidit or a Xbidit authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata
The materials appearing on Xbidit's web site could include technical, typographical, or photographic errors. Xbidit does not warrant that any of the materials on its web site are accurate, complete, or current. Xbidit may make changes to the materials contained on its web site at any time without notice. Xbidit does not, however, make any commitment to update the materials.

Xbidit has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Xbidit of the site. Use of any such linked web site is at the user's own risk.

7. Site Terms of Use Modifications
Xbidit may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Governing Law
Any claim relating to Xbidit's web site shall be governed by the laws of the State of Minnesota without regard to its conflict of law provisions.

9. Seller's Responsibilities
Sellers shall be responsible for verifying that the items they sell adhere to all applicable laws and that the buyer meets all legal requirements to purchase the item.

10. Prohibited Items to Sell on Xbidit
The following products and services are prohibited from being listed on Xbidit:
  a. Illegal drugs and any related drug paraphernalia
  b. Illegal items.
  c. Pornography
  d. Prostitution.
  e. Offensive material.
  f. Counterfeit items. Replica items must be clearly identified as replicas.

11. Product Pricing Agreement
Buyers and sellers shall honor the price agreed upon through the auction process or by buyers who add items to their cart through the seller's store. Prices are guaranteed to be valid in the 50 United States only.

12. Payment Timing/Cancelation
Buyers shall make payment within 3 days of adding items to their cart either directly or through the auction process, if they do not then sellers will be granted the option to cancel the sale. Sellers must honor the auction winning price within the 3 day period. Buyers and sellers have the right to adjust their price at anytime before winning the auction. Buyers and sellers have the right to cancel or quit the auction anytime before an auction is won. Items for pickup: Buyers have the right to cancel the sale after inspecting the item; sellers may offer a holding fee to extend past the 3 day period; if there is a holding fee, it must be applied to the purchase of the item (fee cannot add to the price of the item).

13. Payment Method
Sellers shall accept payments from PayPal for all transactions regardless of the delivery method, ship or pickup. Sellers may accept alternative forms of payment at their discretion.

14. Shipping and Taxes
The price of all items includes all applicable shipping fees and taxes. The seller may not charge any additional fees or taxes.

15. Account Expiration
Accounts that are not logged into for 36 consecutive months may be terminated at Xbidit's discretion. Any credits will be forfeited.

16. Eligibility
Xbidit is open to residents of the 50 United States. Prices are guaranteed and will be honored by sellers for all addresses within the 50 United States. Addresses outside of the 50 United States will not be honored and prices will not be guaranteed.

17. Beta Release Credits
During the Xbidit Beta Release credits are free, users may have a total of 1000 credits in their accounts. When the Xbidit Beta Release is ended all credits accumulated by users during the Xbidit Beta Release period will be forfeited and users will have 0 credits in their Xbidit accounts. After the Xbidit Beta Release additional credits may be purchased from Xbidit. The Xbidit Beta Release is subject to end at any time without prior notification by Xbidit.

18. Acceptable Images and Content
The following conditions apply to content and images for products and stores:
  a. No pornographic material
  b. No nude or semi-nude images
  c. No copyrighted material
  d. Family friendly images only
Xbidit has the right to remove content without notification to the seller.

19. External Links
Sellers may not post external links in their product or item descriptions. Specifically all links which direct buyers to external websites in order to collect payment are expressly prohibited. Sellers agree to sell all items through Xbidit's website. Products or items with external links will be blocked by Xbidit.

20. Violation of Policy
Abuse of this policy may result in your account being locked. Xbidit may modify or remove content to comply with this policy or to improve content (i.e. fix spelling errors to improve search ability).
